question says it all, how can the software developers of applications (peer to peer file sharing) such as napster, be blamed for allowing copyright infringement to occur. reference to the copyright act of australia???

It’s abject nonsense. Peer 2 Peer as a concept is heavily used by developers og legitimate Open Source software. Should the maker of blank VHS tapes, Cassettes, and DVD?CD’s be held responsible for the illegal use they are put too. Indeed if someone gets shot in the street is the arms manufacturer responsible. The Uk proposal’s appear to suggest that we can be barred from the web for excessive downloading even if they cannot prove it is illegal stuff. It is now our responsibility to prove innocence not thiers to prove guilt. It’s becoming more and more a state or even a world where there are two distinct laws for the two distinct groups. I am no way condoning Piracy, stealing is wrong whatever the excuse. But equally wrong is to punish us all guilty and innovent alike to make the rich even richer. Our parents died for the freedom that our Governments are now stealing fom us.

I am a little confused. Does megaupload work similarly to something like limewire in the sense that it is peer to peer file sharing and when someone downloads a file they are then themselves uploading it to others who wish to download the same file (you know, when everyone shares a small part of a file with one anther?) Or with Megaupload when one person downloads a file does their computer activity end there? the reason i ask this question is that i have heard when someone uses a website like Limewire they can then be unknowingly uploading files from their computer regardless of their firewall settings not allowing uploading or downloading - or does this only happen if you have downloading file-sharing software (which i have not).

megaupload is not peer to peer. p2p comes straight from the other person. megaupload files are uploaded to the site, to be downloaded later.

To answer your Q. You don’t upload anything to megaupload, unless you choose to. Otherwise you’re only downloading the file you’re wanting.

Someone told me to beware of "trackers"when I am using bittorrent software to download a peer to peer file sharing network file…why did they tell me to watch out for the FBI and how can I watch out for them anyways?? Am I doing something wrong if I try to watch a tv episode using Bittorrent?

Yes it is illegal. The RIAA is the ones that get people arrested. Read more about it from here,

Apple, Disney Studios, Warner Brothers, NBC Universal,Amazon and even George Lucas herald a change in the way movies are made and ultimately delivered to the public.

Apple in recent days has attempted to stake a claim on the movie download market by striking a deal with Disney Studios to deliver movie down loads. Earlier this year Warner Brothers announced an agreement with the software firm Bit torrent to enable movie downloads to your computer. Bit torrent’s software application has long been the choice of peer to peer file sharing pirates because it allows fast downloads of large files and uses very little bandwidth.

Last week Apple together with Disney studios jumped into the movie down load market and offered two key features to it’s movie download service. First it uses the ipod as the device for downloading. Second, knowing that the ultimate viewing choice for movies for the public will be the television or home theatre. Apple indicates it will introduce a set top box to work with the TV thus bridging the gap between internet delivery and end user’s desired viewing choice.

This puts Apple in a position to capture a middleman role and to make money on a device to ease the process between the down load and final choice of viewing medium. But Bit Torrent is already working with Warner Brothers and will probably leap frog Apple’s device sooner or later by allowing direct downloads to your TV receiver, fast, high quality and immediately playable using a high speed cable line to do it. And to go with this instant down load will be the option to burn to a DVD or store the movie on the hard drive of your tivo box or similar device.

George Lucas in an interview with CNBC earlier this year and again last week stated that the movie companies and Hollywood would have to adapt sooner or later to the new digital age, of production and distribution. When asked about file sharing and bit torrent specifically Lucas stated that it would be the future of Hollywood and that Steve Jobs and others had already grasped that concept.

The major retailers of DVDs, such as Walmart and Target have communicated to the Hollywood studios that they will not sit still for downloads that would be cheaper than the DVDs they sell. Apple has been responsive and is said to be discussing an agreement on the pricing of down loads from it’s itunes site.

As usual the big players are attempting to control how, where and at what price the next generation of movies will be delivered to the public. All the major players want to control the delivery process but the time for that has passed. George Lucas himself said that with web sites like Youtube, film makers can show case their talent and deliver it to the public very cheaply, they don’t need a Hollywood Studio.

Using the internet as a proving ground for content creation and distribution has finally come of age now that high speed internet access is so wide spread. So get ready Hollywood change is coming like it or not.

As a student, you’ve used the student version of a publishing program to create an advertising flyer for your family’s company. You have violated which of these licensing agreements

counterfeiting
commercial use of non-commercial software
peer to peer file sharing
installing the software on multiple computers
yeah, dont feel bad, I dont understand either..

Commercial use of non-commercial software.
Commercial: For a business.

So, you used it for a business even though that’s illegal.

Someone told me to beware of "trackers"when I am using bittorrent software to download a peer to peer file sharing network file…why did they tell me to watch out for the FBI and how can I watch out for them anyways?? Am I doing something wrong if I try to watch a tv episode using Bittorrent?

illegality depends on which country u live in. some places it’s legal to download and share anything, but most places sharing copyrighted material is not legal.

simple the use of a bittorrent client is not illegal. there are many legal uses for bittorrent (such as sharing linux distros). and of course there is illegal use also (such as sharing copyrighted movies).

often various copyright groups will monitor illegal sharing and obtain the ip addresses of computers which are sharing content illegally. using the ip address they can trace the person (or computer) doing the sharing. of course if the computer is using a proxy, then it’s not possible. but most people seem to not be using proxies.

there is nothing illegal about watching a tv episode online. the problem than u run into is that while u are downloading that episode, it is automatically being uploaded (shared) to various other downloaders. this consititutes illegal sharing. if u used a streaming service to watch your tv episode, such as hulu.com or guba.com, then u would not be sharing, only viewing…therefore that would be legal.

now as to "trackers"…those are sites that manage the tiny files that your bittorrent client downloads to enable it to locate the real file u wish to obtain. some tracker sites can log ip addresses of people who download the tiny .torrent files. again, a proxy would gain a person anonymity from this. but most tracker sites do not do this.

i just got to know that opera has built in bittorent software,i was downloading this torrent file that i got to know about it.is it safe?are all my files in computer(including personal info) open to it& thus the world, bugs & trojans?or does it only share info of one folder? If not then whatways does it use coz my opera is both uploading & downloading, with a lot of "peers".I’m scared of it.
also a 200mb file, which downloaded quikly earlier now is taking almost 4 hours to download via bittorent.

You obviously made the recent switch from Limewire (or another similar program) to torrents. Torrents work similarly to Limewire and other P2P programs, the difference being torrents only share the stuff you have downloaded. So whatever you are downloading now, you are sharing with other people so they can download it like you. The reason it was going faster earlier is probably there was someone who was sharing it to you who had a good connection. Usually the connection gets better when all the Dutch or Americans come on, they tend to have better connections.
Torrents are completely safe (depending on where you got it form of course).

Most of the popular video platforms like YouTube, Google, and Yahoo!, plus cool video publishing tools like Blip.TV and VideoEgg, stream video to computers as a Flash file. The file launches a nice video player on your Web browser. Flash has become truly ubiquitous, which is great; it means that virtually everyone can watch video without much hassle. However, there are limitations in quality and the ability to save files. Some experts predict that increased demand will make Flash video look worse and buffer more slowly.

Some smart vloggers like Andrew Baron of RocketBoom provide visitors with options to view and save some files of various size and formats. These vloggers use distribution protocols (including peer-to-peer) so the files download really fast. Distributing quality files is going to become increasingly important as video will inevitably be shown on big screen TV. So receiving high quality video clips will become an imperative. (Beet.TV is going HD this fall, I kid you not!)

We caught up with Robert Levitan, founder and CEO of Pando, a developer of software for sharing large size videos and other big files. It’s built on the BitTorrent open source platform. Earlier this month, Walt Mossberg gave the software a rave review. We’ve been using Pando to send around some of our big Beet.TV files — and it works really well. So, we decided to get the “download” on all of this from Robert. (Oh, and it was the neighborly thing to do as Pando and Beet.TV are in the very same landmark building in Manhattan’s groovy Flatiron District — so Robert just took an elevator to the Beet factory for his interview.)

“Walking in Memphis” is the signature song of American singer-songwriter Marc Cohn, from his self-titled 1991 album Marc Cohn. The song became Cohn’s biggest hit, peaking at 13 on the Billboard Hot 100 and, after being re-released in fall 1991, reached 22 on the UK chart. The popularity of this song helped Cohn win the Grammy for Best New Artist in 1991

The story behind this song: the singer, Cohn, was a young aspiring singer-songwriter from Cleveland, Ohio. He’d never been to Memphis before; in fact he’d never traveled at all. Upon reaching the south he was very moved emotionally after seeing an Al Green sermon, and underwent both spiritual transformation and professional growth. Al Green is referenced in the lyrics as “Reverend Green”. It was there in Memphis he met his first wife Cindy, about whom he wrote the acoustic cult classic “Cindy Sue, I Love You”. The evocative song contains references to Elvis Presley and W. C. Handy.

Many people believe “Walking in Memphis” to be by Bruce Springsteen, and many websites and fan sites credit the song to him. This is, in fact, not true. Bruce Springsteen has never even covered “Walking in Memphis”, his ociation with the song is an urban myth proliferated by internet downloads.

The song is often misattributed to Bruce Hornsby on peer-to-peer file sharing networks and elsewhere. Hornsby has in fact never recorded a version of the song despite the extreme similarity between the vocals.
